These Terms of Service apply to Mantle, a smartphone app for logging sauna and bathhouse visits and sharing them in private conversations, including video calls, with friends who follow each other (together with everything offered through it, the "Service"). The Service is run by an individual (the "Keeper"). Anyone who uses the Service agrees to be bound by these Terms from the moment that use begins.

IWords Used Here

In these Terms, the following words carry the meanings given to them.

  1. (i)"Service" means the Mantle app and every feature, page and piece of content the Keeper makes available through it.
  2. (ii)"Guest" means any person who uses the Service, whether or not that person has an account.
  3. (iii)"Points" means a right of use that exists only inside the Service. Points are not money. They cannot be cashed, refunded, or exchanged for anything of value outside the Service.
  4. (iv)"Content" means any text, image, video, sound, message, record or other material that appears in the Service.

IIWhat These Terms Cover

These Terms govern every dealing between the Keeper and a Guest about the Service. Any guideline, rule or notice the Keeper publishes for the Service forms part of these Terms. Where such a specific rule says something different from these Terms, the specific rule wins.

IIIPersonal Information

The Keeper will handle personal information properly and in line with the Privacy Policy published on this page.

IVNotices

The Keeper will contact Guests, and Guests must contact the Keeper, through the methods the Keeper designates. The contact details a Guest has registered will be treated as current until the Guest reports a change. A notice the Keeper sends to those details will be treated as delivered at the time it is sent.

VOpening an Account

A person who wants an account must apply in the way the Keeper sets out. The account exists once the Keeper accepts the application.

Only people aged 18 or over may apply. By applying, the applicant states and guarantees that this is true.

The Keeper may turn down an application in any of these situations:

  1. (i)the application contains false or misleading information;
  2. (ii)the applicant has broken these Terms before;
  3. (iii)the applicant has not yet turned 18;
  4. (iv)the applicant belongs to, or has dealings with, organized crime or another anti-social force;
  5. (v)the Keeper otherwise judges the application unsuitable.

The Keeper is not required to explain why an application was declined.

VISign-In Details

Each Guest must look after their own email address and password. A Guest must not hand them over, lend them, reveal them or share them with anyone else.

When someone signs in with details matching those registered, the Keeper may treat that activity as the Guest's own. The Keeper will not be liable for harm caused by another person using a Guest's sign-in details, except where the Keeper acted intentionally or with gross negligence.

VIIConduct Not Accepted

A Guest must not do any of the following while using the Service:

  1. (i)break any law, or act against public order or accepted morals;
  2. (ii)do anything connected with a crime;
  3. (iii)infringe anyone's intellectual property, portrait rights, privacy, reputation, or any other right or legitimate interest;
  4. (iv)put excessive load on any network, server or system behind the Service;
  5. (v)get in the way of the Keeper running the Service;
  6. (vi)gain, or try to gain, unauthorized access to the Service or its systems;
  7. (vii)gather, store or use information about other Guests without permission;
  8. (viii)use the Service for a dishonest or unlawful purpose;
  9. (ix)cause anyone else loss, damage, discomfort or nuisance;
  10. (x)pretend to be another person;
  11. (xi)advertise, promote, solicit or sell without the Keeper's permission;
  12. (xii)use the Service to seek romantic or sexual encounters with people of the opposite sex whom the Guest does not already know;
  13. (xiii)give any benefit, directly or indirectly, to an anti-social force;
  14. (xiv)send or post anything obscene, any child pornography, or anything that depicts or encourages the abuse of children;
  15. (xv)obtain Points by improper means;
  16. (xvi)do anything else the Keeper judges inappropriate.

VIIIPauses in the Service

The Keeper may stop or suspend the Service, in whole or in part, without telling Guests beforehand, when:

  1. (i)systems need inspection, maintenance, repair or updating;
  2. (ii)an earthquake, fire, flood, power cut or other event beyond the Keeper's control makes running it impossible;
  3. (iii)a computer, communication line or other equipment fails;
  4. (iv)the Keeper otherwise judges that the Service cannot reasonably be provided.

The Keeper will not be liable for harm a Guest or anyone else suffers because of such a pause, except where the Keeper acted intentionally or with gross negligence.

IXRestricting an Account

Without warning, the Keeper may restrict what a Guest can do in the Service, cancel that Guest's Points, or delete the account, if the Guest:

  1. (i)breaks any part of these Terms;
  2. (ii)is found to have registered false information;
  3. (iii)uses a payment method that has been suspended;
  4. (iv)leaves fees or other amounts owed unpaid;
  5. (v)cannot be reached for a certain period;
  6. (vi)has been inactive for a certain period;
  7. (vii)is otherwise judged by the Keeper to be unsuitable.

The Keeper will not be liable for harm that follows from these steps.

XLeaving Mantle

A Guest may close their account through the procedure the Keeper provides. When a Guest leaves, any amount they still owe the Keeper becomes due at once and must be paid immediately.

All Points held by a Guest who leaves are lost, and nothing is refunded for them. Information about a former Guest is handled under the Privacy Policy. Unless the law requires it to be kept, it may be erased once a set period has passed.

XIPoints

A Guest can obtain Points by buying them or by meeting conditions the Keeper sets. The Keeper may also give Points free of charge.

Points will not be refunded, paid out in cash or swapped for anything else, unless the law demands it or the Keeper expressly allows it.

If 180 days go by without a Guest signing in, every Point that Guest holds expires and is lost.

A Guest must not obtain Points:

  1. (i)by deception;
  2. (ii)with a payment method they have no right to use;
  3. (iii)by taking advantage of a defect or error in the Service;
  4. (iv)by any other improper method.

If the Keeper finds that Points were obtained in any of these ways, the Keeper may cancel them, restrict the Guest's access, or delete the account. When an account is closed or deleted, its Points lapse and no compensation is paid.

XIIChanges to the Service

After giving Guests notice, the Keeper may change, add to, suspend or end the Service. The Keeper will not be liable for harm a Guest suffers as a result.

XIIIChanges to These Terms

The Keeper may change these Terms without each Guest's individual consent in either of these cases:

  1. (i)the change serves the general interest of Guests;
  2. (ii)the change does not run against what the agreement is for and is reasonable, considering why it is needed, how fair the new content is, and any other relevant circumstances.

Before a change takes effect, the Keeper will tell Guests what is changing and the date it starts to apply.

XIVNo Transfer of Position

A Guest may not, without the Keeper's prior written consent, transfer, hand on, lend, pledge or deal in any other way with their position under this agreement or any right or duty that comes from it.

XVWarranties and Liability

The Keeper gives no promise, express or implied, that the Service has no factual or legal defects. No promise is made about its safety, reliability, accuracy, completeness, effectiveness, security or fitness for a particular purpose, and it may contain errors or bugs or infringe someone's rights.

The Keeper bears no liability for harm a Guest suffers through using the Service, unless the Keeper acted intentionally or with gross negligence.

If the agreement between the Keeper and a Guest is a consumer contract under the Consumer Contract Act of Japan, the paragraph above does not apply. Even then, the Keeper is not liable for harm arising from special circumstances, whether or not the Keeper foresaw or could have foreseen them. For harm caused by the Keeper's ordinary negligence, the Keeper's liability is capped at the usage fees the Guest paid the Keeper in the month the harm occurred.

The Keeper takes no responsibility for any dealing, communication or dispute between a Guest and another Guest or any other person.

XVILaw and Court

These Terms are interpreted under the laws of Japan. Any dispute about the Service will be heard at first instance only in the court that has jurisdiction over the place where the Keeper is based, and the Keeper and each Guest agree to that court's exclusive jurisdiction.

Mantle is run by an individual (the "Keeper"). This document sets out how the Keeper treats information about the people who use the Mantle app and its related features (each a "Guest"; together, the "Service"). It covers information the Keeper obtains through the Service.

IWhat Is Collected

The Keeper may collect:

  1. (i)account information, such as an email address, a password and sign-in tokens;
  2. (ii)profile information, such as a display name and a profile picture;
  3. (iii)device and usage information, such as which device and iOS release are in use, the IP address, server access records, crash logs, and activity history within the Service;
  4. (iv)purchase information, such as which items were bought and whether a transaction went through.

Card numbers and other payment details are processed by Apple or another outside payment provider. The Keeper never receives or keeps them.

IICamera, Microphone and Photos

The Service asks for access to the camera and microphone so that Guests can make video calls. Picture and sound from a call are used only to carry the call as it happens. The Keeper will not record, watch, listen in on, or permanently store call picture or sound on a server, unless the law requires it or a public authority makes a lawful demand.

The Service also asks for access to the photo library, so that a Guest can choose pictures for a profile icon or a post. Only the pictures a Guest picks are used.

IIIWhy It Is Used

The Keeper uses collected information to:

  1. (i)offer the Service, keep it running and make it better;
  2. (ii)manage accounts and confirm that a Guest is who they say they are;
  3. (iii)answer questions, reports and requests;
  4. (iv)prevent, spot and look into unauthorized access, misuse, breaches of the Terms and security problems;
  5. (v)learn how Guests use the Service, so that it becomes better, safer and easier to use;
  6. (vi)send important notices, such as updates, maintenance and changes to this Policy.

IVDisclosure to Others

The Keeper will not give personal information to a third party without the Guest's consent, except when:

  1. (i)a law requires it;
  2. (ii)it is needed to protect a person's life, body or property where consent is hard to obtain;
  3. (iii)it is needed to look into or handle fraud, intrusion, a security incident or a breach of the Terms;
  4. (iv)the law otherwise permits it.

VOutside Services

To provide features and to keep the Service stable, high in quality and secure, the Keeper may rely on services and software development kits supplied by others, such as tools for sign-in, crash reporting and usage analysis. Those providers may collect information under their own privacy policies.

VIKeeping It Safe

The Keeper takes reasonable steps, within what an individual operator can practically do, to protect personal information against leaks, loss, damage, unauthorized access, alteration and misuse. Because the Service runs over the internet, no protection can be guaranteed to be complete.

VIIDeleting an Account

A Guest can ask for their account to be deleted from the settings inside the app, or by writing to the support address. After deletion, the Keeper will erase the Guest's personal information within a reasonable time. Information may be kept where there is a legitimate reason to do so, such as complying with the law, managing payments, handling disputes, preventing misuse or protecting security.

VIIIUpdates to This Policy

The Keeper may revise this Policy when laws change, features are added or changed, outside tools change, or the way the Service is run changes. Significant changes will be posted inside the Service or announced in some other suitable way. Unless stated otherwise, a revised Policy applies from the moment it is posted.

You have reached Mantle's support page. Write to the address above with a question about the app, a problem you ran into, a bug report, a request to delete your account, or an idea for something new. Every message that arrives is read.

What to send

None of this is required, but it helps the Keeper look into a problem faster: what you were doing when it happened, which screen you were on, which iPhone and iOS release you have, and the address your account is registered under.

How support is run

Mantle is built and run by one person. A reply can take a while, and not every message receives an individual answer. Messages that need a response will be answered wherever possible, though a reply cannot be promised. Bugs that need fixing may be addressed in a later update.

Problems with other Guests

The Keeper does not step into disputes, harassment or other trouble between Guests, and takes no responsibility for it. If someone is bothering you, block them in the app. You can also report a message or a user from the menu in any chat or post.

Points and purchases

If you paid for something and the paid content or Points did not appear, write to the support address. The Keeper will check what happened and take appropriate action.

Getting the reply

If you use a spam filter or limit which senders can reach you, set it to accept mail from mantle-cs@outlook.jp so the reply is not lost.
